Terms of Use

Overview

These Terms of Use ("Terms") constitute a legally binding agreement between you and GhostRec ("we", "our", "us", or "the app"), governing your use of the GhostRec application and related services. By downloading, installing, or using GhostRec, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our app.

Account Registration & Usage

You may need to create an account to use certain features of GhostRec. You are responsible for keeping your account information confidential and secure. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are solely responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with this section.

Subscription Information

Subscription Options & Billing

GhostRec offers the following subscription options:

  • Monthly Subscription: Access to premium features on a monthly renewal basis
  • Annual Subscription: Access to premium features on a yearly renewal basis at a discounted rate

Subscription details:

  • All payments are processed by Apple through your App Store account
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions by going to your account settings in the App Store after purchase
  • No refunds will be granted for any partially used subscription period

Subscription prices may change at our discretion. If the subscription price changes, we will notify you before your next billing cycle.

Free Trial Terms

We may offer a free trial period for our subscription services. The following conditions apply to free trials:

  • Free trial eligibility is determined at our discretion
  • At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends
  • You may be required to provide your payment details to start a free trial
  • We reserve the right to modify or terminate free trials at any time

Cancellation Policy

You can cancel your subscription at any time through your App Store account settings. Cancellations will take effect at the end of your current billing period. After cancellation, you will continue to have access to the subscription features until the end of your current billing period.

User Conduct & Restrictions

When using GhostRec, you agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Attempt to gain unauthorized access to any part of the service
  • Reverse engineer, decompile, or attempt to extract the source code of the app
  • Use the app in any way that could damage, disable, or impair the app or interfere with others' use
  • Use automated means or scripts to access or collect data from the app
  • Use the app for any illegal or unauthorized purpose

Intellectual Property Rights

GhostRec and its content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any of the material on our app without our explicit permission.

We acknowledge the following third-party intellectual property used in our app:

  • HaGRIDv2 dataset (Hand Gesture Recognition Image Dataset) by Alexander Kapitanov, Karina Kvanchiani, Alexander Nagaev, Roman Kraynov, and Andrei Makhliarchuk, used under Creative Commons Attribution-ShareAlike license
  • YOLOv10x model architecture for hand gesture recognition

App Permissions

Camera Access

GhostRec requires camera access to enable hand gesture recognition functionality. By using the app, you grant permission for camera access solely for the purpose of real-time hand gesture detection and recognition. All camera data is processed locally on your device and is not stored or transmitted.

Disclaimer of Warranties

THE APP AND ALL SERVICES PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE APP'S CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS, OR LINKS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE APP.

Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the app or your violation of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by updating the "Last Updated" date at the top of these Terms and by providing additional notice as appropriate, such as through the app or by email. Your continued use of the app after such changes constitutes your acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

Termination

We reserve the right to terminate or suspend your account and access to the app at any time, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

App Store Terms

Apple App Store

If you downloaded the app from the Apple App Store, the following additional terms apply:

  • These Terms are between you and us, not with Apple
  • Your use of the app must comply with the App Store's Terms of Service
  • We, not Apple, are responsible for the app and its content
  • Apple has no obligation to provide maintenance or support for the app
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable) to you
  • Apple is not responsible for addressing any claims related to the app or your possession and/or use of the app
  • Apple and its subsidiaries are third-party beneficiaries of these Terms

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the app and supersede all prior agreements and understandings, whether written or oral.
